With the following Privacy Notice we, Fotografiska Emerging GmbH (hereinafter "Fotografiska", "we" or "us"), like to inform you how personal data is processed in the context of your participation in the open call "Foto of the Day" (hereinafter the "Open Call") on our website www.emerging.fotografiska.com (hereinafter the "Website").In case of further questions, please do not hesitate to contact us under the contact details specified in Section ‎2.

3. Personal data that is processed, purposes and legal bases of processing

3.1 Registration

We collect and process the following data from you upon registration on our Website:

  • Your name and surname,
  • Your e-mail address,
  • Your Instagram profile or online portfolio URL, if provided by you during the registration process (optional).

The social media channels or online presences provided by you will be published together with the photo submitted by you in the case that your photo is selected by the Fotografiska jury as "Curated Photo", to allow interested parties to discover more artistic works of you. Providing this information is voluntary and your consent may be revoked by you at any time with effect for the future.

Processing is carried out on the basis of Art. 6 (1) (b) GDPR (i.e. the performance of the Agreement on Participation in the Open Call "Foto of the Day"). If processing is based on your consent, legal basis is Art. 6 (1) a) GDPR.

3.2 Double-Opt-in-Procedure

After registering, participants will receive an email containing a confirmation link as part of the double opt-in procedure. The processing of personal data within the double opt-in process is based on Art. 6 (1) (b) GDPR, as it is necessary to verify the Participant’s identity and to complete the registration, and on Art. 6 (1) (c) GDPR, where applicable, to comply with legal obligations to document consent.

3.3 Notification

We use your email address provided at registration to notify you via email (i) if your photo was selected as "Curated Photo" and also (ii) if your photo was not selected as "Curated Photo".

Processing is carried out on the basis of Art. 6 (1) (b) GDPR (i.e. the performance of the Agreement on Participation in the Open Call "Foto of the Day").

3.4 Publication

If your photo is selected as "Curated Photo" we may publish your photo on our Website, social media channels, and regularly issued newsletters. In this context we may also publish your name and the social media channels or online presences provided by you voluntarily at registration (Section 3.1) together with your photo.

Processing is carried out on the basis of Art. 6 (1) (b) GDPR (i.e. the performance of the Agreement on Participation in the Open Call "Foto of the Day").

3.5 Exhibition

If your photo is selected as "Curated Photo" we may publish your photo on digital screens (together with your name and the social media channels or online presences provided by you voluntarily at registration (Section 3.1) in the Fotografiska museums (worldwide).

Processing is carried out on the basis of Art. 6 (1) (b) GDPR (i.e. the performance of the Agreement on Participation in the Open Call "Foto of the Day").

3.6 Disclosure to other Companies of the Fotografiska Corporate Group

We may disclose your personal data as specified in Section 3.1 to the following companies of the Fotografiska corporate group for the purposes specified in Section 3.4 and 3.5:

  • Fotografiska Group GmbH
  • Fotografiska Stockholm AB
  • Fotografiska Holding AB
  • Fotografsika Emerging GmbH
  • Fotografiska Trademark AB.

The disclosure of your personal data is carried out on the basis of Art. 6 (1) (b) GDPR (performance of the Agreement on Participation in the Open Call "Foto of the Day").

3.7 Disclosure to Third Parties

We may disclose your personal data as specified in Section 3.1 to third parties, i.e.:

Media partners solely for editorial reporting on the Contest,

Partners solely for joint marketing activities related to the Contest .

The disclosure of your personal data is carried out on the basis of Art. 6 (1) (b) GDPR (performance of the Agreement on Participation in the Open Call "Foto of the Day").

3.8 Storage and deletion of your personal data

Unless a specific duration of data storage is specified in this Privacy Notice, we will only process your data as long as this is necessary for the respective purposes (e.g. for performance of the Agreement on Participation in the Open Call "Foto of the Day") or as long as there are legal retention obligations. After the respective processing purpose ceases to apply and retention obligations end, your data will be routinely deleted.

3.9 Your rights

You can request information about your stored data. If you have provided personal data on the basis of a contract or consent, you have the right to receive this data in a standard and machine-readable format.
